The inspection plan for the second half of this year has been approved by the Guarantor for the protection of personal data. The plan, the first to be launched after the full application of the EU Regulation, sees the data inspections carried out by companies and public administrations that manage large databases, data protection measures at the center of the inspectors’ checks. in credit institutions (especially with reference to data breach reports), the processing of data for telemarketing activities.
The inspections will also be carried out in collaboration with the Guardia di Finanza special privacy and telematic fraud unit on the basis of the memorandum of understanding that strengthened the collaboration between the Guardia di Finanza and the Guarantor.
The controls will focus on compliance with the disclosure obligations, on the acquisition of consent in the cases provided, on the data retention period and on the security measures for their protection , and will take into account, in particular, the compliance with the obligations regarding the keeping of the treatment register, impact assessment and designation of the Data Protection Officer. The inspection activity will also concern, as usual, the investigations launched on the basis of reports or complaints submitted by citizens, with particular attention to the most serious violations.
Meanwhile, the balance of the assessment activity carried out in the first half of 2018 indicates an increase in penalties collected by the tax authorities for sums of over € 4 million and € 500 thousand (with an increase of 162% compared to corresponding semester 2017), mostly concerning large telephone operators. The contested sanctions also increased to 647 (118% compared to the first half of 2017). Reports to the judicial authorities for criminal violations remained stable: 19, most of which related to non-compliance with the Guarantor’s provisions, failure to adopt the minimum safety measures, violations related to remote control of workers.
The assessments of the first half of 2018 , also carried out with the contribution of the Special Privacy Unit of the Guardia di Finanza, focused, for the public sector, on the processing of data carried out by the Asl and then transferred to third parties for research purposes, on the release of digital identity to Italian citizens (Spid), on the tax system, with particular attention to security measures and the audit system. As regards the private sector, the inspection activity focused on the companies that deal with assessing the risk and solvency of companies and on telemarketing.
